Who we are

Which laws apply

Two frameworks govern the personal data we handle through this website.

• The General Data Protection Regulation (EU 2016/679), because we address visitors located in the European Union and our hosting is in France.
• UAE Federal Decree-Law No. 45 of 2021 on the Protection of Personal Data, in force since 2 January 2022, because MK LUXE LLC is established in Sharjah Media City. That free zone is covered by the federal law. The separate regimes of the DIFC and the ADGM do not apply to us.

Where the two differ, we apply whichever standard gives you the stronger protection.

What we collect

• Information you send us through the contact form: your name, your email address, your company name and the content of your message.
• Technical data recorded automatically by our hosting provider: IP address, browser type, pages requested, date and time. These server logs exist for security and troubleshooting.

We do not use analytics or advertising tools on this website, and we carry out no profiling and no automated decision-making.

Why we use it

• To answer your enquiry and, where relevant, to prepare a proposal. Legal basis: steps taken at your request before entering into a contract, and our legitimate interest in responding to business enquiries.
• To keep the website secure and available. Legal basis: our legitimate interest in protecting our infrastructure.

We do not sell your data, and we do not send marketing emails unless you have asked us to.

Cookies

This website sets no analytics, advertising or tracking cookies. WordPress may set strictly necessary cookies, for example when a member of our team signs in to the administration area. Cookies of that kind do not require your consent.

Who else is involved

• Hosting: OVH SAS (OVHcloud), Roubaix, France. Website data is stored in France.
• Fonts and scripts: some assets are loaded from api.fontshare.com, cdnjs.cloudflare.com and unpkg.com. When your browser requests these files, those providers receive your IP address and basic technical information about your device.
• Email: messages sent through the contact form are delivered to our mailbox and stored there.

Transfers outside the European Economic Area

MK LUXE LLC is established in the United Arab Emirates. Messages you send us may therefore be consulted from outside the European Economic Area. Such access is limited to what is necessary to answer you, and we apply appropriate contractual and technical safeguards.

How long we keep it

• Contact form messages: up to three years from our last exchange with you.
• Server logs: up to twelve months.

Your rights

Under the General Data Protection Regulation you may ask for access to your data, correct it, request its deletion, restrict or object to its processing, and receive a copy in a portable format.

UAE Federal Decree-Law No. 45 of 2021 gives you comparable rights: access to your data and to information about how it is processed, correction or erasure, restriction of processing, objection to processing, portability, and withdrawal of consent where the processing rests on it. Withdrawing consent does not affect anything we lawfully did before you withdrew it.

Write to contact@yesagency.fr and we will answer within one month.

If you consider that your rights have not been respected, you may lodge a complaint with the CNIL, the French data protection authority, at cnil.fr, or with the UAE Data Office, the federal supervisory authority created by Federal Decree-Law No. 44 of 2021. The executive regulations of the UAE law have not yet been published and that office is not yet fully operational, so we ask you to write to us first and we will deal with your request directly.

Security

The whole site is served over HTTPS. We keep WordPress and its extensions updated and limit access to the administration area to a small number of accounts.

We update this page whenever our practices change. The date below tells you when it was last reviewed.
